«The redefinition of the Arbitration Exception in the Brussels I bis Regulation»

The arbitration exception in the Brussels I Regulation has long been cause for concern and debates. In 2012, the European lawmaker did not amend it, but clarified certain issues in a new Recital of the Brussels I bis Regulation. In June 2022, the Grand Chamber of the CJEU delivered its judgment in the London Steam-ship case which might be the first step of a redefinition of the arbitration exception and the imposition of certain rules of the Regulation on arbitral tribunals. This conference will discuss what the future of the arbitration exception might be.

 

Professor Cuniberti is author of eleven books and numerous articles written in English and French. His most recent work is a comparative commentary of the UNCITRAL Model Law on International Commercial Arbitration published in the Elgar Commentaries in Private International Law Series.

Professor Cuniberti has been involved in a number of legislative projects, and has served as an expert for the European Commission, the European Parliament, the European Law Institute and UNIDROIT. Since 2019, he has been the president of the European Association of Private International Law and a regular contributor to its blog.

He has been a visiting professor at various universities in Europe, Asia and the United States, including Columbia Law School and National University of Singapore. He holds a Doctorate in Law from Paris I Panthéon-Sorbonne University and an LL.M. degree from Yale Law School.
